Insurance conditions

CLAUSE 1. GENERAL TERMS

  1. Who is insured?

    The persons listed on the policy/premium collection note or the tour operator's confirmation, or the persons listed on the insurance policy if the insurance premium has been paid (in the following referred to as "the insured").

  2. When does the insurance policy take effect and terminate?

    The insurance policy will take effect when the deposit/rent has been paid to the rental agency and run until such time as the rental period commences. However, the holiday home rent insurance will provide cover for the entire rental period.

CLAUSE 2. CANCELLATION INSURANCE WITHOUT DEDUCTIBLE

  1. Sum insured

    The price of the hiring of the holiday home/package tour exclusive of the insurance premium.

  2. Which insurance events are covered?

    The insurance policy will provide cover in the event that it is not possible to complete the holiday because the insured or his/her spouse or cohabite, parents, sister, brother or child, or any serious, acute illness or injury suffered by such person which requires:

    Death.

    Sudden illness or injury.

    Unexpected aggravation of an existing illness.

    Vaccination intolerance.

    Pregnancy.

    Fire or burglary at the Insured’s private residence or place of busi­ness immediately prior to departure.

    Significant damage to property belonging to the insured due to fire, natural phenomena or a wilful offence committed by a third party.

    The insured's loss of a job or a fellow traveller risk person's loss due to unexpected operational termination of employment by the employer.

    The insured's or a fellow traveller's taking up of a job, if such person was unemployed at the time of booking the trip, and the Employment.

    Service has approved the trip.

    Risk persons are:

    a) Insured and his/her spouse, children, parents, sister or brother.

    b) The insured's lifemate or one of the insured's fellow travellers.

    c) The persons who have minors or relatives requiring care who are not part of the trip in their custody.

    d) The persons who have booked and insured a trip with an insured and their relatives.

    e) In the event that more than six people have booked the trip together, only the insured's relatives and lifemate and persons in the insured's custody are covered.

  3. What is covered?

    1. In the event that the trip is not commenced, the insurance policy will cover the costs that the insured is liable to pay to the rental agency pursuant to the rental agreement.

    2. If the start of the trip is delayed due to any of the causes mentioned in Item 1 ("Which insurance events are covered?") or due to delays in public transport lasting more than two hours, Europæiske will pay the provable additional costs incidental to the insured commencing the trip up to the costs of cancellation.

  4. What to do in case of an insurance event:
    Obligations of the insured:

    1. To notify the rental agency of the cancellation immediately following the insurance event in order to keep the cancellation costs as low as possible.

    2. To submit the insurance policy and the booking documents with the cancellation bill to the rental agency.

    3. To document serious accidents, unexpected serious illness or the deterioration of an illness, pregnancy and vaccination intolerance by means of a medical certificate, mental illness by means of a psychiatrist's certificate and death by means of a death certificate.

    4. To submit the termination letter in the event of loss of a job, a confirmation from the Employment Service that the trip has been approved and documentation of withdrawal from the Employment Service as proof of the employment in the event of the taking up of a new job.

CLAUSE 3. HOLIDAY HOME RENT INSURANCE

In addition to the cover provided by the cancellation insurance without deductible, the holiday home rent insurance further covers:

  1. Interruption

    In the event of interruption of a holiday trip due to the causes mentioned in Clause 2.1., the policy will cover the insured's rent payments for the days following the interruption of the trip. If the trip is interrupted after 12.00 noon, compensation will be paid from the following day. The insurance policy will not cover unused transportation.

  2. Contents/Liability insurance

    3.2.1 Extent of cover

    The insurance policy covers the liability for damages incurred by the insured pursuant to the rental agreement for damage to the household effects in the rented holiday home during the insurance period, including damage to glass panes and bowls.

    3.2.2 Exceptions

    Compensation will not be paid for:
    a) Normal wear and tear, scratches, grazes, smudges or gradual deterioration.

    b) Theft committed by the insured or the insured's visitors.

    c) Liability for damages in respect of damage inflicted wilfully.

    d) Liability for damages in respect of damage inflicted by the insured under self-induced intoxication or the influence of narcotics or other drugs when this is a significant contributory cause of the damage.

    e) Damage inflicted by dogs or other pets.

    f) Bicycles and vessels, including windsurfing boards, rowing boats, canoes and kayaks, including parts thereof.

    g) Cosmetic damage to bowls, including Jacuzzis and whirlpool baths.

    h) Damage to swimming pools and the water therein.

    3.2.3 Insurance amount

    The insurance amount is up to EUR 10.000 for damage to household effects during the insurance period.

    3.2.4 Deductible

    The deductible is EUR 67,- per instance of damage.

    3.2.5 Calculation of compensation

    a) Compensation for totalled household effects will be calculated according to the following principles: Compensation for effects that are less than two years old, and which where otherwise undamaged prior to the damage, will be the replacement cost of similar new effects. Compensation for effects that are more than two years old will be the replacement cost of similar new effects less 10 per cent per commenced year from the year of purchase. Compensation for such effects will as a minimum be 20 per cent of the replacement value.

    b) The company may elect to have damaged effects repaired or to pay an amount corresponding to the decrease in value.

    c) The company is entitled but not obliged to pay compensation in kind.

    3.2.6 Recognition of claim for damages

    The company is only obliged to compensate for costs incurred with the approval of the company. The insured's recognition or payment of a claim for damages will not bind the company. By recognising the liability for damages, the insured will risk having to pay the damages himself.

    3.2.7 What to do in case of an insurance event

    The insured must immediately report an instance of damage to the rental agency and submit the required documentation.

    llness/Injury/Death=It is a condition for Europæiske’s liability to pay compensation that the Insured procures a medical certificate stating the diagnosis from the attending physician at the location/destination and that the Insured upon request grants Europæiske’s physician access to all relevant medical reports including information on previous ailments. In the event of curtailment, the Insured must consult the physician at the location/destination before departure.

    Fire or Burglary=In the event of fire or burglary, the completed claims form shall be accompanied by a police report.

    Unemployment=In the event of unemployment a copy of the written notice must be submitted. In the event of commencement of a new job a copy of the employment contract must be submitted.

    3.2.8 Double insurance

    The insurance policy will not cover costs covered by another insurance policy.

    3.2.9 Sum Insured

    The sums insured and part sums stated in the conditions for each individual cover limit Europæiske’s liability to pay compensation in all insurance events occurring during the insurance period/package tour.

    3.2.10 Right of recourse

    In the event that the claim is covered by an insurance of property, the tortfeasor's liability for damages pursuant to the Danish Liability for Damages Act (erstatningsansvarsloven) and thus the liability insurance cover will lapse, unless the damage was inflicted wilfully or in an act of gross negligence.

    3.2.11 Insurance Complaints Board

    If any dispute or controversy arises between the Insured and Europæiske in connection with the insurance, and if a renewed appeal to Europæiske does not result in a satisfactory outcome, the Insured may lodge a complaint with:

    Complaints to the Insurance Complaints Board must be submitted on a special form, and the Insured is charged a minor fee. The complaints form and giro transfer form for the payment of the fee are obtainable from:

  3. Legal venue
    Proceedings against Europæiske Rejseforsikring A/S will be brought before the Copenhagen City Court or the Eastern Division of the Danish High Court, Copenhagen, Denmark. Disputes arising from the present insurance must be settled according to Danish legislation.

    Stamp duty
    Stamp duty is payable in accordance with section 70 of the Danish Stamp Duty Act. 4.8

    Definitions
    For the purposes of this insurance the below mentioned words shall be defined as follows:

    Acute Illness=An acute illness entitled to cover under the terms of this policy is taken to mean a newly occurring serious illness or an unexpected deterioration of an existing or chronic illness.

    Household contents=Articles belonging to the normal equipment of a private household including carpets. Buildings and walls and fixtures are not household effects - however, kitchen tabletops are considered as household contents.

    Special private household contents=Antiques, tape recorders, record and cd-players or the like, MP-3, compact discs and mini discs, amplifiers, loudspeakers, works of art, paintings, music instruments, radio-, DVD and television sets with accessories and Oriental rugs.

    Cover for windows and wash basins=This covers is defined as the breaking of any window glasses in the building, ceramic hotplates, bowls, cisterns, washbasins and spas, whirlpools and ordinary bath tubs.

    NOTE

    In the event of litigation, the original Danish version of the above conditions is the solely valid version.
